AAPNS Concrete Decking Disclaimer

AAPNS does NOT recommend installing a concrete pool deck. There are many reasons for this, which we highlight below. If this disclosure does not dissuade you from using concrete, then you understand and agree to the following:

  1. Due to soil and weather conditions in North Texas, concrete is expected to crack.
  2. There are no best practices, materials, engineering methods, or companies that can ensure your concrete decking will not crack.

    (If someone ever figures out how to do this, they would surpass Amazon and become the first trillion-dollar company.)
  3. TXDOT often uses 11-inch-thick concrete with #6 steel (3/4") reinforcement, and it still fails at a 100% rate.
  4. AAPNS provides no warranty against cracking, heaving, sinking, lifting, or any other undesirable event.
  5. Due to the natural characteristics of concrete and the inability of humans to achieve perfection, variations in color, levelness, texture, pattern, and even client expectations are not warrantable defects or valid claims.
  6. There are no warranties of any kind, for any reason, whether implied or expressed, written or verbal, provided by AAPNS.
  7. The client understands and agrees not to make any claims or threats of any kind for any reason related to concrete, construction practices, or workmanship, including claims backed by third parties.
  8. The client understands and agrees that they are fully responsible for their concrete decking and that AAPNS does not inspect, repair, or address concrete after it is poured, even if the client offers to pay for such services. The client further agrees to contact another contractor for inspection or repairs. AAPNS does not currently and will not in the future offer these services.
  9. AAPNS agrees to enter into this contract to build the pool only if the client fully adheres to all of the above conditions.
  10. At any time before pool excavation begins, AAPNS will refund the cost of the concrete decking charged. Additionally, we will reduce our guaranteed construction timeline by one week as a thank-you. The project will proceed to completion, and the client may hire another company to pour the concrete after construction is finished. AAPNS will not warranty any work performed by others and will not delay the project while another company completes the decking.
  11. Clients wishing to avoid concrete decking should upgrade to pavers before pool excavation begins.
